Subject to mandatory legal rights, LPU's aggregate liability arising from any claim relating to the Services shall not exceed the greater of:

• USD $100; or

• the total amount you paid to LPU for the applicable Services during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for:

• death or personal injury caused by negligence where such liability cannot legally be excluded;

• fraud or fraudulent misrepresentation;

• willful misconduct;

• any liability that cannot lawfully be excluded or limited under applicable law.

28. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless LPU and its officers, directors, employees, instructors, affiliates, licensors, and service providers from claims, losses, damages, liabilities, and reasonable costs arising from:

• your unlawful use of the Services;

• your infringement of another person's rights;

• User Content submitted by you;

• your negligent or intentional misconduct.

This obligation does not apply to the extent a claim results from LPU's own negligence, willful misconduct, or violation of applicable law.
